According to the requirements of EU market surveillance and product compliance regulations (EU) 2019/1020: From July 16, 2021, all products with the CE mark need to be located in the EU (except the United Kingdom) as a product compliant Contact person (hereinafter referred to as "person in charge"). Except for medical equipment, ropeway devices, civil explosives, hot water boilers and elevators, all CE-marked products are subject to this regulation. Products sold in the UK will not be subject to this regulation.

What is the CE mark?

The CE mark is a self-certification mark applied by the manufacturer to the product. A product with the CE mark indicates that the product meets the health, safety and environmental protection standards of the European Economic Area (EEA). Generally speaking, the CE label can be printed on the product itself, product packaging or other accompanying documents (for example: instructions). In addition, EU legislation requires manufacturers to issue corresponding EU Declaration of Conformity (DoC) for all CE marked products.

If you sell goods with the CE mark and are manufactured outside the European Union, you need to ensure that such goods have a responsible person in the European Union (except the UK) before July 16, 2021. Otherwise, after July 16, 2021, if you sell CE-marked products without the information of the person in charge of compliance, the behavior will be considered illegal.

Warm reminder: As a European Amazon merchant, you need to ensure that your products with the CE mark have the contact information of the person in charge before July 16, 2021. Such labels can be affixed to the product itself, product packaging, package, or accompanying documents (for example, instructions).

01. How to confirm whether it is necessary to comply with the new regulations for CE standard products?

First of all, you must confirm whether the products you want to sell in the European Economic Area require CE marking.

Different categories of CE marked products have different directives and regulations to control them.

02. Who can be the contact person for product compliance in the EU?

The following types of entities have the qualifications of "person in charge":

● Manufacturers or brands in the EU

● Importers in the EU

● Authorized representative in the EU

● Delivery service providers in the EU

● The person in charge cannot be located in the UK

03. What are the duties of the responsible person in the EU?

As your guarantor of product compliance in the EU, you have the following responsibilities:

● Collect the EU declaration of conformity of the product, and ensure that when receiving a request from the relevant EU agency, it can provide additional documents proving that the product meets EU standards in a language that the relevant agency can understand.

● Relevant documents include: EU Declaration of Conformity (DoC), technical documents (such as third-party test reports, safety certification certificates, etc.).

● Inform relevant agencies of any risks that may be caused by the product.

● Take necessary corrective measures to correct any non-compliance issues of the product.

04. How to appoint a "person in charge" for a brand of CE marked products?

At this stage, all brand owners of European sites are requested to complete Amazon brand registration as soon as possible. Because Amazon brand registration is the first step for the EU responsible for brand product declaration compliance. After completing this operation, Amazon will communicate with you as soon as possible to inform you how to declare the EU responsible person of the brand/ASIN.

Once you have a compliance officer, you can directly provide the relevant documents (test reports and conformity declarations) that prove product compliance to your EU officer.

05. How to appoint a "person in charge" for a CE marked commodity distributor?

If you do not have a brand, but a distributor of CE-marked products, it is recommended that you communicate with upstream suppliers:

First ask if they have a subsidiary in the EU or already have an EU importer.

If not, you need to confirm whether they are aware of the new product safety regulations that will be implemented and make sure that they take appropriate action to appoint a compliant person in charge in the EU.

You can also ask for help from product testing laboratories or companies that certify products for safety, and ask if they can provide the service of a responsible person.
